New Policy Update to Protect Hundreds of Thousands of “Aged Out” Children


The U.S. government has made a new rule to help kids whose parents come to work in the U.S. with a temporary visa. The rule aims to protect these children from having to leave the U.S. while their parents wait for a green card, which can take years. If the child turns 21 while the parent is waiting for a green card, the child might lose their legal status.

More than 200,000 kids who grew up in the U.S. and whose parents have temporary visas are at risk of losing their legal status when they turn 21. Around 10,000 of them lose their legal status every year.

A law passed in 2002 allowed kids to “freeze” their age while their parents’ green card application was being processed. However, the government used a chart that made it hard for kids to stay legal if they turned 21. The new rule lets applicants use a different chart to apply for a green card, and it takes effect immediately.
